1. App Description

DesiCal is a calorie tracking application designed for South Asian cuisine. The app uses AI-powered image recognition to identify food items and estimate their nutritional content, helping users track their daily calorie intake.

2. Subscription Terms

• DesiCal offers a free tier with limited scans and a premium subscription (DesiCal Pro) for unlimited access.
• New users receive a 3-day free trial of DesiCal Pro upon signing up.
• Subscriptions are billed monthly or annually through your Apple ID account.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• You can manage or cancel your subscription at any time through your Apple ID account settings.
• No refunds will be provided for any unused portion of a subscription period. Refund requests should be directed to Apple.

3. AI-Generated Nutritional Estimates

Important disclaimer: All nutritional information provided by DesiCal is generated by artificial intelligence and should be treated as estimates only. These estimates are not verified by nutritionists or medical professionals.

• DesiCal is not a medical device and does not provide medical advice.
• Nutritional estimates may vary from actual values and should not be relied upon for medical dietary requirements.
• Consult a healthcare professional or registered dietitian for medical nutrition advice.
• DesiCal is intended for general wellness and informational purposes only.

4. User Responsibilities

• You must be at least 13 years old to use DesiCal.
• You are responsible for maintaining the security of your account.
• You agree to provide accurate health profile information for proper calorie calculations.
• You agree not to misuse the app or attempt to interfere with its operation.
• You are responsible for any content (photos) you submit through the app.

5. Intellectual Property

All content, features, and functionality of DesiCal, including but not limited to the design, code, and AI models, are owned by DesiCal and are protected by intellectual property laws.

6. Limitation of Liability

To the maximum extent permitted by law:

• DesiCal is provided "as is" without warranties of any kind, express or implied.
• We do not guarantee the accuracy of AI-generated nutritional estimates.
• We are not liable for any health decisions made based on information provided by the app.
• Our total liability for any claims arising from your use of the app shall not exceed the amount you paid for the subscription in the 12 months preceding the claim.

7. Termination

We reserve the right to suspend or terminate your access to DesiCal at any time, with or without cause, with or without notice. You may stop using the app and request account deletion at any time by contacting us.

8. Changes to Terms

We may update these Terms of Service from time to time. Continued use of the app after changes constitutes acceptance of the updated terms. We will notify users of significant changes through the app or via email.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
